Michael Cherney - Not British Court

Michael Cherney the Russian who runs the Michael Cherney Foundation and a network of self promotional web sites, is trying to get a multi billion dollar settlement from Oleg Deripaska, the owner of the Russian aluminium giant Rusal.

In order for Michael Cherney to get his case heard in a London court, his lawyers have got to convince the London judge that a British court is an appropriate forum for the determination of the claim.

To most observers this would seem like a sticking point - as this dispute has nothing to do with the British. Neither Michael Cherney or Oleg Deripaska live in Britain and the dispute originates thousands of miles away, in Russia, and involves a Russian company.

If the case does go to court, then it is likely to be very expensive for Mr. Cherney to bring as when a non UK domiciled party sues in the UK, the defending party has the right to ask for security for costs in the event that the case fails. Michael Cherney must therefore deposit a substantial sum to cover the costs of Oleg Deripaska.

I am always amazed at the disconnect between how individuals understand the law and what takes place in reality. Police make an arrest. They don’t read the arrestee their constitutional rights. They don’t allow a phone call. They use overly aggressive interrogation tactics. They will literally do anything to insure a conviction. Anything you say or do WILL be used against you, even though they will tell you otherwise. Laws of this country generally permit them to lie during an interrogation. They often do, and people are coerced into acting against their own interest, and contrary to their constitutional rights. They will tell you you are helping your case, while you are actually ensuring your own conviction.
If you are contacted by the police, call me immediately. BEFORE YOU HAVE ANY CONTACT WITH THEM.
If you are arrested, SAY NOTHING until your lawyer is present. The police will most likely tell you ” you don’t need a lawyer for this” or ” you want to make it hard on yourself then?” or “Don’t worry, we’ll make sure the charges are dismissed later” or ” just sign this and well get you out of here”
Countless times I have been hired by people who could have been released w/o charges or been later found not guilty if they had only refused to speak until their lawyer was present.
Unfortunately, you cannot trust the police or any other law enforcement. Their objective is to convict you primarily,and they do not have your best interests in mind. They are often conditioned to ignore evidence which points to innocence, and to overemphasize evidence which points to guilt. This results in wrongful arrests, and the miscarriage of justice.
Quite simply, having an attorney present is your ONLY option.

You may have heard about Michael Cherney recently as he’s trying to sue his former business associate Oleg Deripaska in a London Court.

Michael and Oleg used to be business associates when they both lived in Russia - and Michael taught Oleg a lot and introduced him to some important people in the business and political world.

However Oleg overtook Michael in most areas of business life and even joined the inner circle of the power brokers of Russia - while Michael had to flee Russia in fear of his life - he’d simply made too many powerful enemies.

Although they’re both multi billionaires, Oleg is now far richer than Michael - and was about to become even richer with the IPO of his company, RusAl - until Michael Cherney spoiled things by timing a court case to coincide with the London IPO.

He was on his way home from a White Sox game in late July. As he exited the elevated train station at North and Clybourn, he was confronted by an upset and angry man who claimed that He had insulted his girlfriend. The man told the police that He had attacked him without provocation, and had then fled the scene. The man was hospitalized for his injuries and sought to have He prosecuted with Aggravated Battery.

Upon being retained by He, Attorney Robert Callahan began an in depth investigation. All police reports were obtained and all relevant witnesses interviewed. During the investigation, Attorney Callahan discovered a missing police report. The report had been prepared by a certain Chicago Police Detective, and the State’s Attorney’s had not tendered it to the defense. This missing report explained that the alleged victim had been armed with a metal pipe at the time of the altercation. None of the reports tendered by the State’s Attorney’s office mentioned a pipe.

Attorney Callahan used the missing report during cross-examination of the State’s witnesses at trial. The complainant’s first witness admitted for the first time that the complainant had been armed with a pipe. She did not mention a pipe at any time during her testimony on direct examinaton by the State, and in fact said that the victim had NOTHING IN HIS HANDS. When confronted with the report she now admitted that he had been armed.

Largely due to this and other major inconsistencies uncovered by Attorney Callahan, He was found NOT GUILTY.

Having had a close friend who was killed in a drunk driving accident, the topic truly makes me want to scream. Apparently, someone who was leaving a bar after having a few too many drinks, hit her head on. She probably never even knew what was coming. He survived, she didn’t. The worst part is that he barely even got punished for it – lost his license and got probation. He ruined so many lives and never even apologized. I have recently heard that he’s back barhopping again, so obviously he learned his lesson very well.
