Michael Cherney - Not British Court

Michael Cherney the Russian who runs the Michael Cherney Foundation and a network of self promotional web sites, is trying to get a multi billion dollar settlement from Oleg Deripaska, the owner of the Russian aluminium giant Rusal.

In order for Michael Cherney to get his case heard in a London court, his lawyers have got to convince the London judge that a British court is an appropriate forum for the determination of the claim.

To most observers this would seem like a sticking point - as this dispute has nothing to do with the British. Neither Michael Cherney or Oleg Deripaska live in Britain and the dispute originates thousands of miles away, in Russia, and involves a Russian company.

If the case does go to court, then it is likely to be very expensive for Mr. Cherney to bring as when a non UK domiciled party sues in the UK, the defending party has the right to ask for security for costs in the event that the case fails. Michael Cherney must therefore deposit a substantial sum to cover the costs of Oleg Deripaska.
